General Terms and Conditions of All Impact GmbH (Valeriana)
Scope, subject matter, written form
The following general terms and conditions apply to all services covered by the contract, including any supplements. Supplementary orders , including consulting services for the platform www.valeriana.ch
As soon as the All Impact GmbH (Valeriana) has confirmed the requested service and appointment, an order relationship and the contract are concluded. Both parties can cancel the order immediately and at no cost at any time. As soon as the appointment has been made and the regular frequency has been agreed, the order is deemed to be activated for both sides and is binding. The dissolution of the contract is possible in the first month at any time without notice. From the 2nd month, a notice period of one month at the end of the month applies. Please note down your regular bookings in your calendar. We'll send you an E-Mail every month with an information about the upcoming dates but this is an extra service from our side. The regular booking is valid anyway. In case you go on holidays please inform All Impact GmbH (Valeriana) at least 3 days in advance. In case the door is locked we'll charge the booked hours. A short E-Mail notification is sufficient.
Services and scope
All Impact GmbH (Valeriana) accepts orders from customers who have placed their order on www.valeriana.ch. A contract between the customer and All Impact GmbH (Valeriana) only comes into existence when All Impact GmbH (Valeriana) has confirmed the booking request and the order has been allocated accordingly. Services offered include: sewing & mending, washing & ironing and domestic help. The subject of the order is the execution of the services agreed upon the order and not a certain success or a specific result.
The specified duration per use is for guidance only. Only the actual time is charged. Additional changes and additions on the order of the client are a Auftragveränderung- and extension and will be charged separately. Unless the ordered time is sufficient for the order, no warranty can be given.
Decisive for the issuance of the bill is the work or hourly report. The employees record the number of hours worked. Subsequently, the invoice will be invoiced with the order date. The report forms the basis for invoicing and reflects the time spent.
The time agreed upon ordering is adhered to, whenever possible, and serves as orientation and framework; in the case of additional expenditure or assignment of additional orders, time differences may occur.
All Impact GmbH (Valeriana) selects the right employees. The client has the right to choose another employee. However, this is only possible if a reason is given for the change. The contract is not tied to specific employees. The absence or replacement is no reason for the immediate termination of the contract. However, All Impact GmbH always strives to ensure that the same employees work on site, thus ensuring personal interaction and building relationships.
The instructions sent by e-mail for customers, as well as the checklist sent in the order confirmation is an integral part of all orders and contracts, which is to be observed by both parties.
Agreed appointments must be canceled 24 hours in advance (excluding weekends). If an appointment is not canceled in time, we unfortunately have to charge normally. Not timely canceled appointments will be charged. During the year, 5 appointments may be canceled by customers if a regular service is booked. This is how we prevent income loss for our employees. During the notice period, no appointments may be canceled, otherwise the notice period will be bypassed. If a long absence is planned, a break can be made, after agreement with All Impact GmbH.
If our employees are sick or go on vacation, All Impact GmbH will inform in advance. If possible, a replacement is organized. However, this can not always be guaranteed, since staff shortages can exist.
Final cleaning with acceptance guarantees, evictions or furniture shifts, curtain and carpet cleaning are not offered or executed.
Customers provide the equipment, such as the vacuum cleaner, the mop (including mop cloths) for the moist absorption of the floors and a bucket free of charge. If special rags are to be used for cleaning work, this should also be provided directly by the customer.
All other utensils (sponges, microfibre cloths (wet and dry cleaning), non-abrasive sponges, feather dusters and detergents (bath, kitchen, glass, oven, toilet and limescale, degreaser and all-purpose soap) are brought by the Valeriana employees themselves. We work with eco-friendly products of the Uni Sapo brand, the products are already covered by the hourly wage and will not be billed separately.Customers endeavor to provide the best possible support to our employees in fulfilling the contract.
If objects and objects are damaged due to incorrect work equipment, all liability is excluded by All Impact GmbH (Valeriana). The operating regulations are authoritative.
Conditions and due date
A booked hour consists of 55 minutes working time. Customers undertake to settle the amount owed by the service provided within 10 days. A first reminder is free. In the second reminder, All Impact GmbH (Valeriana) reserves the right to charge CHF 50.-, as additional expenses have been incurred. All expenses incurred in connection with an operation will be charged in full to the customer.
Due diligence and liability
All Impact GmbH (Valeriana) carries out the commissioned tasks carefully and with the best possible protection of the interests of the customers and ensures their success. The customer agrees to assist in the fulfillment of the contract. Customers are concerned, for example, that the Mopp cloths are washed every time they are used, auxiliary material is available and the housekeeping is accessible.
The All Impact GmbH (Valeriana) has a public liability insurance. This insurance is liable for consequential damage in the context of legal liability (personal injury and property damage up to CHF 5 million). For other damages, beyond the public liability (goodwill), the liability of All Impact GmbH is limited to CHF 500.-. Likewise for damages of any kind, for which the insurance company refuses a liability. All Impact AG (Valeriana) is only liable for intent and gross negligence.
Wear of equipment or objects or minor scratches on the parquet or on glass or ceramic surfaces are no damages and are therefore excluded from any liability (irons, vacuum cleaners, etc). Surfaces, furniture or other materials which require special care are to be communicated to the employees before the work commences. If this does not happen, any liability is excluded.
If the Valeriana employees take care of sewing, washing or ironing, the utmost care is taken. Always inform employees about special features, eg care, etc. Clothes made of silk or other sensitive materials (wool) are to be handed over directly to the textile cleaning. For this no liability can be taken over.
If damage occurs, the damage must be inspected or verified. Therefore report damage within 24 hours to All Impact GmbH (Valeriana). Receipts etc. must be made available. For subsequently reported damages any liability is rejected.
For one-off orders there is no liability for damages.
Key delivery and loss
Loss of the key excludes all liability. It is the customer's decision to give employees a key. In the case of loss by the employee himself, however, liability is waived as long as the key of an employee of All Impact GmbH (Valeriana) has been given by means of a key receipt. If keys are deposited in post boxes or similar places, any liability is excluded. At the end of the order or change, the normal key return takes place via depot in the mailbox or in person. Keys are not sent by mail.
All Impact GmbH (Valeriana) confirms that all employees employed meet the legal requirements in every respect and that the employment conditions fully meet the requirements of the collective agreement of the cleaning industry.
Trade secret, confidentiality
All Impact GmbH (Valeriana) and its employees undertake not to pass on to third parties any information they learn in the context of the contractual relationship. This concerns in particular documents of all kinds, residential, income and ownership. The customer also agrees that he is subject to secrecy for trade secrets.
Business secrets are any information the disclosure of which could harm All Impact GmbH (Valeriana) and its employees in any way whatsoever. This duty of confidentiality continues even after the termination of the contractual relationship.

All legal relationships between All Impact GmbH (Valeriana) and the client as well as these General Terms and Conditions shall be governed by Swiss law. Jurisdiction is the seat of All Impact GmbH (Zurich).
If an agreement in the context of this contractual relationship is ineffective, then the contract remains otherwise valid.
